PRODUCT INFORMATION AND PRICING

the Patio District reserves the right to change product pricing or information at any time. Therefore prices on our website may not be accurate. In the case that an item is ordered off the internet before we have updated our prices, the customer will be notified and given an option to cancel or pay the difference on the order. In the case that a price of an item is lowered after a purchase is made,the patio District will not refund the difference to the costumer.

TPD does its best to create an accurate representation of all the products featured on our website. In some occasions we may show a picture that does not exactly match the product but helps illustrate what it will look like. In these instances we will ship the item the customer ordered (even though it may be slightly different than the image) it is the customers responsibility to check product information and specs beforehand.

TPD offers free shipping on orders over $250. You can rest easy knowing that your orders over $250 will be shipped to your home free of charge.

Easy shipping only applies to continental U.S locations.

TPD will not charge any restocking fee in the event of a return or exchange.

 SHIPPING SPECIFICATIONS

Flat rate and free shipping policy applies to products via standard shipping to locations in the continental United States. TPD reserves the right to choose delivery type, carrier, and service level of each shipment sent via standard shipping.  In any case an order involves freight shipment, standard shipping includes curbside delivery and gate service. In the event that a delivery requires special considerations, (these include but are not limited to hard to reach locations, condominiums, dirt roads) these special considerations may have an additional fee not included in standard shipping. In the case that additional fees are required, we will contact you to notify you of these fees and give you a chance to adjust your shipping location if you chose to. TPD does not ship to APO/FPO addresses at this time.

All shipments, unless specified, are curb-side shipments. All larger shipments, shipped by means of freight carrier, will require a signature at the time of delivery. If you authorize the shipping company to leave the delivery without a signature,TPD cannot be held responsible for damages that may occur during delivery. It is the customer’s responsibility to inform us of any problems with this type of delivery at the time of purchase.TPD will not be responsible for shipping costs on products not delivered due to a shipping companies inability to deliver to a particular location. Said circumstances may include but are not limited to: narrow or winding roads, dirt or gravel roads, and vacant establishments or hard to reach areas. Installation and in home delivery is not available even if the costumer is willing to pay more.

In the event that merchandise is returned because it is not deliverable due to an incorrect address, the customer will be responsible for shipping both ways. Orders for larger items that must ship freight require the shipping company to contact the customer prior to delivery. If the product is returned because the freight company could not reach the customer, this will be considered a return, and the order will be subject to our regular return policies.

TPD facilitates international shipping in the form of freight forward drop off. It is the customer’s responsibility to provide TPD with the location of the desired freight forward as well as an authorization to deliver to said freight forward. At this point, the merchandise will be considered delivered and TPD will not be liable for future damages. It is the customer’s sole responsibility to schedule delivery to the final destination. The customer is responsible for all duties and tariffs on shipments.

DELIVERY INSPECTION

Standard Delivery:

If your shipment arrives through a typical delivery service such as UPS or FedEx, you have 3 days to call us at (1-800) 643-4714 to report any damages.

Freight Delivery:

If you authorize the freight company to leave freight without a signature, TPD cannot be held liable for any damages or missing pieces. Leaving a note is the same as signing for your products in good condition.

When ordering via Freight please follow the following steps:
Step 1: Ensure that the pallet/piece count on the delivery receipt matches the number of pallets/pieces you receive. If a pallet(s) or piece(s) is missing:
  • Note this on the delivery receipt before you sign. Example: “Received 4 of 5 pieces”
  • Call us at 1-800-634-4714 immediately to let us know you are missing pallets/pieces. We will coordinate with the shipping company to locate the missing pallets/pieces or replace them.
Step 2: Inspect the packaging for external damage. If you notice exterior damage:
  • Open the box and inspect for concealed damage before signing the delivery receipt.
  • If you see any damages to the packaging or products please note on the delivery receipt by specifically writing the word “Damaged” before signing. Signing your delivery receipt without noting any damages legally states that you have received your freight in good condition.
Step 3: If there is no visible external damage, please sign for your freight.
Step 4: Please inspect your items for concealed damage after the driver has left.

30-DAY EZ RETURNS

We allow you to return all new, unused, and resalable items in their original packaging within 30 days of delivery for a full refund (minus actual shipping costs incurred by us for the shipping back). Returns because of an error in our part will not have any cost.

Returns due to products defects, other than possible damages incurred during shipping process shall be done directly through the manufacture. TPD is more than happy to facilitate this process for you. Contact us at 1-800-634-4714 for more information.

If your return will be coming back via freight truck, we will require you to get us a photo before your return will be authorized! Before picture is required in case there is any damage to the item on its way back to us.

CUSTOMER SAFETY & SECURITY

All purchasing transactions take place over a secure connection. While theoretically someone could be listening to the conversation between your computer and our server, they could not understand it. It is encrypted with the highest standards and latest technologies possible.

 CUSTOMER PRIVACY

TPD will not provide or sell any information you give to us to any other company or third party. We understand and respect that your personal information is given to us for purchasing and shipping reasons only.

INTERNATIONAL ORDERS

At this time TPD does not facilitate international Shipping, however we are more than happy to drop off a particular order at the carrier of your choice within the continental United States. Customers interested in international orders must contact our office during business hours to coordinate accordingly.

General Terms and Conditions 

If plans & permits are necessary, the customer must review and check the plans before THE PATIO DISTRICT begins construction, any modifications by the customer’s request after the plans have been signed and sealed by the engineer and/or approved by the city, will have additional costs.

The cost for plans and permit processing is not refundable if the plans are not approved by the city or if the customer decides to not proceed or cancel the project.

The customer is responsible for providing an updated survey (and elevation certificate if needed) of no more than 6 months old to submit to the city (CITY REQUIRED).  THE PATIO DISTRICT does not provide additional reports or work requested by the city such as soil reports, soil statements, compaction statements, and pilings.

The customer is responsible to arrange the access of materials to the property and place of installation. Any modification that needs to be made to enter the premises to install the pergola is the responsibility of the customer.

THE PATIO DISTRICT is not responsible for any additional finishes that the city may require like, landscaping, grass installation or other work around the construction area.

The time frame of construction is only determined by The Patio District and in many cases it may vary depending on several factors such as weather, inspections, city requirements and unforeseen conditions.

THE PATIO DISTRICT will not accept any returns on any materials once delivered or picked up. THE PATIO DISTRICT is not responsible for the installation of any electric connections, unless quoted or additional agreement is made in writing.

If the customer is not ready for any reason on the time agreed for delivery and installation, THE PATIO DISTRICT will require the customer to pay 90% of the total cost. The remaining 10% will be retained by the customer, to be paid off on new delivery and installation date. An additional fee will be applied on the new delivery date.

If your project requires plans & permits, City Fees are to be paid by customer (Application Fee, Building Permit Fee, etc.) Any modifications done to the project after The Patio District has finalized such will null and void any warranties offered.

The terms and conditions are included in the design and customer order by reference to these Terms & Conditions.

Shipping dates are approximate and are not guaranteed for a particular date or time. The Patio District shall not be liable for delay in shipment, or for failure to manufacture, due to causes beyond The Patio District’s control. Reasonable control including & without limitation to delays in receipt of or unavailability of materials, strikes, accident, acts of purchaser, government action, embargoes, priorities and allocations. The date of delivery shall be extended for such time as may be reasonably necessary to enable The Patio District to ship. The Patio District’s only duty in such case is to reasonably notify the customer of the delay or non-delivery. We shall complete the work within a reasonable time, but shall not be held responsible for delays beyond the control of The Patio District. (Initials)

The Patio District assumes no responsibility for any unusual soil conditions encountered that is not specifically referred to in our proposal. Also, The Patio District assumes no responsibility for the excavation, removal or disposal of any contaminated soils, roots, or rocks encountered during the process of our construction. Any incurred expenses suffered by The Patio District under these circumstances will have to be paid by the client.

The Patio District shall not be responsible for any damage to trees (or the removal of such) and surrounding landscaping. Shall any tree roots, rocks or debris impede the construction area these will need to be removed at the client’s expense.

It is the customers responsibility to advise The Patio District of the existence and location of all underground structures such as sewers, waterlines, gas lines, utility lines, etc. that may be encountered throughout the process of our construction. In the event that the identity or location of any underground structure varies from those specified herein, any extra cost incurred protecting or covering the same shall be borne by the customer.

It is expressly understood that all terms, modifications, agreements and conditions relating to this contract are ONLY those expressed in writing herein, and that there are no oral representations, undertakings, terms, agreement or modifications of any kind.

The price specified within signed invoice is legally binding and forms part of the contract with The Patio District. Please be aware any additional work, which is not specified as part of the contract will be subject to an additional charge that will be reflected in a new or revised invoice.

1. Structure Limited Warranty

The Pergola is made with PINE Pressure-Treated wood, that protects the wood from attack by termites, other insects, and fungal decay, and has a 10 year warranty directly with the manufacturer; the structure has a warranty of one year with THE PATIO DISTRICT that covers any manufacturer defects. It does not cover for misuse or damages caused by the owner, fissures or twists due to the behavior of the natural elements or damages caused by weather conditions.

THE CUSTOMER HAS A GRACE PERIOD OF ONE YEAR FROM DATE THE PERGOLA IS FINISHED TO REQUEST A FREE OF CHARGE SERVICE TO THE PERGOLA (FISSURES REPAIR, PAINT WHERE NEEDED)

2. Stain Finish Limited Warranty
The stain/ paint has a warranty of a period of six months, any maintenance after this period is the responsibility of the customer, THE PATIO DISTRICT offers a maintenance service after the warranty period expires at an extra cost.

3. Sunscreen Fabric & clear Polycarbonate Warranty

The Sunscreen fabric and polycarbonate have a warranty of 2 year from the day that the pergola is finished, any repairs or modifications to be done after this period; will have a charge, which will be determined depending on the repairs.

4. THE PATIO DISTRICT is not responsible for gutter installations on the pergolas or the house in case it is needed.
5. Pergolas attached to the house will be subject to the height of the existing structure and will not be constructed above the overhang

6. The customer is responsible for the removal and re-installation of window or door shutters for pergola installation.
7. THE PATIO DISTRICT will not accept any returns on Pergolas; each pergola is exclusively built to the customer’s request and design.

8. If the customer changes the design of the pergola after THE PATIO DISTRICT has already cut the wood and the beams have been done, the customer is responsible for all extra costs that the new design and new wood may acquire.

9. Fan and Fixtures are to be provided by the customer and the installation of such is a complimentary service not part of the scope of work.

NOTE: Due to the behavior of the natural elements the wood may present a variation on the color, occasionally may twist and it might show fissures on the beams and columns.
